Abstract

O objetivo principal deste trabalho foi realizar um estudo para verificar a viabilidade da atribuição do poder de polícia ambiental para o Corpo de Bombeiros Militar de Santa Catarina (CBMSC), especificamente para o crime previsto no artigo 41 da Lei 9.605/98 (Lei de Crimes Ambientais) utilizando o auto de investigação em incêndio florestal para comprovar a culpa ou dolo do agente causador do sinistro. Com referência aos aspectos metodológicos, foi utilizada a técnica da documentação indireta, a qual o autor utilizou fontes primárias como leis e decretos, fontes secundárias abrangendo bibliografias já publicadas e livros sobre o assunto, além de sites especializados, também foi detalhado o case do Corpo de Bombeiros Militar do Mato Grosso, pioneiro no poder de polícia ambiental no Brasil. Por fim, o autor chegou a conclusão de que é possível o CBMSC figurar no rol de autoridades executoras do poder de polícia ambiental, conforme proposta deste trabalho, sendo necessário apenas alguns ajustes na legislação estadual.
