Abstract

Ente público, duração do trabalho, intervalo intrajornada e horas extras são os assuntos mais recorrentes das ações que ingressam na justiça do trabalho e evidenciam a necessidade de avaliação da norma que regulamenta a execução da jornada de trabalho dos militares estaduais, principalmente pela existência de regras que limitam a equalização da jornada excessiva. O trabalho teve como objetivo geral identificar, contextualizar e comparar elementos de desequilíbrio na regulamentação da jornada de trabalho dos militares estaduais, considerando as atividades com vedação de registros de horas excedentes, principalmente aquelas realizadas em áreas de desastre. O método de pesquisa será hipotético-dedutivo, com abordagem quantitativa de foco perspectivo, pesquisa bibliográfica e documental de objetivo descritivo. Os resultados evidenciaram a necessidade de maiores estudos sobre a aplicação da regra excepcional que desequilibra a relação de trabalho e que constituem um passivo para futuras cobranças judiciais e a necessidade de estabelecimento de regras para aplicação das restrições que causem menor acúmulo de horas não compensadas sem prejuízo do atendimento necessário.
