Abstract

O presente trabalho faz um estudo sobre a dificuldade de responsabilização do agente causador de incêndios florestais, em que pese a maior parte destes incêndios estar ligada à ação humana. Para tanto, utilizou-se da pesquisa bibliográfica para apresentar as competências legais dos órgãos públicos estaduais e federais atuantes em Santa Catarina com alguma incumbência sobre os incêndios florestais, ocorridos em terras onde cabe atuação do Estado ou da União, sobretudo por haver previsão legal para o crime de incêndio, incluindo os florestais. Com o auxílio da pesquisa de campo, o trabalho registrou como se dá a participação desses órgãos públicos no processo de identificação e responsabilização do incendiário, indicando os principais gargalos que dificultam a atuação dos entes estatais. Por conseguinte, apresenta as melhorias sugeridas por estes órgãos para que a participação do Estado nesse processo seja aprimorada, recomendando ações mais efetivas para resolver o problema.
